He isnt actaully in Check right now. He isnt allowed to put himself into Check so the computer figures its a draw since he cant move.

Yar, you've put him in stalemate. People who are better than me at chess and losing can sometimes force a stalemate rather than outright lose.

If the king is not under direct attack, and has 0 legal moving options, it is considered a stale-mate.

Yeah, That's why it's said Check and Mate.
King must be in check, and not be able to move any where to get out of check, to be check mate. In the instance you block all moves by the king, but fail to actually check him, he has forced a stale mate. Which is a very difficult and knowledgeable tactic to prevent loss.
