Tippmann “Tell Us Your Story” On-Line Contest

Official Rules: “Tell us your Tippmann Story” On-Line Contest:

NO PURCHASE NECESSARY. A PURCHASE WILL NOT INCREASE YOUR CHANCE OF WINNING.

1. ENTRY PERIOD: Contest starts at 12:00:01 a.m. Eastern Time (“E.T.”) on March 2, 2007 and ends at 11:59:59 p.m. E.T. on December 15, 2007 (“entry Period”).
2. ELIGIBILITY: There is no purchase necessary to enter the Contest or win a prize. Entry is only open to Tippmann Paintball Players. Minors, to be eligible, must have parent or legal guardian permission. Employees of Tippmann Sports, LLC (“Sponsor”), its parent companies, affiliates, subsidiaries, advertising and promotion agencies, and the immediate family members (spouse, and parents, children and siblings, and each of their spouses, regardless of where they live) and persons living in the household of each of these individuals, whether related or not, are ineligible. Void where prohibited.
3. HOW TO ENTER: Tell us your Tippmann story (in English) by filling out the website entry form. Attach a photo and submit electronically. To enter by mail, print out and send your completed website entry form and photo to: P.O. Box 8490, Madison, WI 53708. All entries must be postmarked by December 15, 2007 and received by December 30, 2007 or received electronically no later than 11:59:59 p.m. ET on December 15, 2007. Each original entry may only be submitted via one method of entry. Postage due mail will not be honored. By submitting an entry, the entrant irrevocably assigns and transfers to the Sponsor any and all ownership rights, including all intellectual property rights, title and interest in the write-up/testimonial and photo entry, including, without limitation, all copyrights. Entry write-up/testimonial and photo must be the original work of the entrant. Each entrant gives Sponsor his/her express consent to the public posting of his/her photo and to being publicly identified by full name and geographic location. Each entrant hereby releases any and all claims whatsoever in connection with the use and reproduction of his/her photograph and name. Sponsor is not responsible for any lost, delayed, damaged, misdirected or illegal entries. No entries will be returned. All cost associated with mailing and submitting an entry are the entrant's responsibility. Sponsor will not reimburse or be responsible for any cost incurred in the making or submission of any entry. Each entrant acknowledges that Sponsor and its agents may publish, use, adapt, edit and/or modify his/her entry in any way, in any and all media, without limitation, and without consideration to the entrant.
4. JUDGING: Judging will take place following the Entry Period by a panel of judges with paintball expertise.
5. PRIZE: Three (3) Grand Prizes: Only one prize will be awarded for the Tippmann 98, A-5, and X-7 categories. Each respective category winner will be featured in an upcoming Tippmann print ad. Winner will be notified via a traceable method of delivery and may be required to complete, have notarized and return an Affidavit of Eligibility/Release of Liability and Publicity Release within seven (7) days of date notice sent or prize will be forfeited.
6. CONTEST TERMS: By participating, entrants or, if an eligible minor, his/her parent or legal guardian agrees to: These Official Rules and the decisions of the judges and Sponsor, its parent company, subsidiaries, affiliates, advertising and promotion agencies and each of the respective officers, directors, shareholders, agents and employees of the aforementioned entities (collectively the “Releasees”), from any liability, claims, or damages arising out of their participation in the Contest and the acceptance, use, misuse or possession of any prize, including without limitation, any travel or activity related to the prize or any production of the print ad. Prize won by an eligible minor will be awarded to minors with parent or legal guardian’s approval. Tippmann Sports, LLC reserves the right to cancel this contest at any time and for any reason.
7. LIMITATION OF LIABILITY: Releasees are not responsible for computer network, technical, mechanical, printing, typographical, human or other errors, problems or malfunctions relating to or in connection with the Contest, including, without limitation, errors, problems or malfunctions which may occur in connection with the administration of the Contest, the announcement of the prizes, the processing, tabulation or posting of times or registrations or in any Contest-related materials; illegible or garbled times, registrations or entries. Contest shall be governed by, and construed in accordance with, the laws of the State of Illinois, without giving effect to any choice of law or conflict of law rules. By entering, entrants consent to the jurisdiction and venue of the federal, state and local courts located in Cook County, Illinois.
8. WHO WON: To find out who won, mail a self addressed, stamped envelope to: Tippmann Contest Winners Department, P.O. Box 8490, Madison, WI 3708 for receipt by July 15, 2008.
9. SPONSOR: Tippmann Sports, LLC, Buffalo Grove, IL 60089.

Sponsor has the right to feature more than one grand prize winner and may show any entry or any part of any entry on the Tippmann web site or related web sites.

PRIVACY POLICY AND MODEL RELEASE

In consideration of acceptance of my submitted photo as part of the Tell Us Your Story, I hereby grant Tippmann, and others with Tippmann’s consent, all ownership rights including intellectual property rights in and to the submission (photo and text), including the right to copy, distribute, publish, display, modify and otherwise use the photo and text for purposes of Tell Us your Story program or for any advertising or publicity on behalf of the Tippmann or similar future programs.

I understand that the photo and text may be cropped, edited, electronically manipulated or otherwise altered, and that whether the photograph is used is entirely for Tippmann to decide.

I certify that I am the photographer and sole copyright owner of this photo and text, or I have the owner's permission to submit this, and I have obtained the consent of all identifiable persons shown in the photo in the form attached as “Consent” and submitted such signed consent to Tippmann with any entry.

I agree to reimburse Tippmann for all damages and expenses (including attorney's fees) they may incur from claims based on their use of my submitted photo or text.

I understand and accept that use of any personal information I submit will be governed by Tippmann's privacy policy, for which there is a link on this page. I am at least 18 years old and have full legal authority to transfer these rights to Tippmann or I am under 18 and my parent or guardian has read and accepted these terms for me. I am not under 13 years old.

All submissions to the Tell us Your Story are reviewed. Tippmann reserves the right to reject any entry without notification. Tippmann will notify those whose pictures have been accepted. Accepted submissions will be sent a consent form prior to use.
